Website: shoremeter.app
Application: ShoreMeter
1. Purpose of the application
ShoreMeter is a mobile application intended to provide an informational display of the user's approximate distance from the nearest sea coast and the current boating speed in knots.
Based on user-configured rules, the application may display a warning indicating whether planing is permitted or prohibited according to configured coastal distance and speed thresholds.
The application is not intended to replace official nautical charts, maritime navigation, mandatory safety equipment, legal advice, or official information issued by competent authorities.
2. Informational nature of data
All calculations in the application are informational. Distance from the coast is calculated based on device location, the accuracy of GPS or other location services, locally stored coastline data, and an algorithm for determining the nearest coastline segment.
The application may display rounded values, for example distance rounded to approximately 10 meters. Actual distance from the coast may differ due to GPS limitations, device quality, weather conditions, signal interference, coastline data quality, geometry simplification, and other technical factors.
3. Use at your own risk
The user uses the application at their own risk. The user remains solely responsible for safe boating and for compliance with all applicable rules in the country and area where navigation takes place.
The user must always follow local maritime regulations, official nautical charts, maritime signage, bathing zones and protected areas, port, environmental and local regimes, weather and sea conditions, and instructions issued by police, harbor master authorities, coast guard, or other competent authorities.
The application must not be used as the only source of information for decisions regarding planing, vessel speed, safe coastal distance, or navigation.
4. Country rules and settings
The application may include default settings for individual countries or regions, for example default coastal distance values and default speed limits.
These settings are provided solely for informational purposes and may differ from currently applicable legal requirements. Rules may change, may vary by area, and may contain exceptions.
The user may modify these values. By changing settings, the user assumes full responsibility for the correctness and appropriateness of the values used.
5. Application warnings
The application may show warnings such as "Planing allowed", "Planing prohibited", "Slow cruising", "No GPS signal", "Poor GPS accuracy", or "No coastline data loaded".
These warnings are the result of technical calculation and user-configured values. They do not constitute official confirmation that a specific action is lawful, safe, or permitted in a concrete situation.
6. Coastline data
The application uses coastline data that may originate from open-source data sources, including OpenStreetMap and other publicly available geographic datasets.
To support performance and manageable data sizes, data may be simplified. Therefore, deviations may exist between displayed and actual coastline positions.
Coastline data may contain errors, omissions, or simplifications. The application provider does not guarantee completeness, accuracy, or timeliness of coastline data.
7. Application operation
For proper operation, the user must grant access to device location. Without location access, the application cannot calculate current distance from the coast or boating speed.
The application may require an internet connection to download coastline data, update coastline package lists, display advertisements, and deliver potential future updates to settings or content.
After coastline data has been downloaded, basic calculations may function without a continuous internet connection, provided required data remains stored on the device.
8. Advertisements
The application may be funded by displaying advertisements. Ads may be delivered through external advertising networks, such as Google AdMob.
Advertising providers may process certain data, such as device data, advertising identifiers, approximate location, app usage data, and other data depending on user privacy settings, consent choices, and device configuration.
Further details regarding data processing are set out in the Privacy Policy.
9. Limitation of liability
The application provider strives to keep the application functional and data as useful as possible, but does not warrant that the application will always operate without errors, interruptions, delays, inaccuracies, or technical issues.
The application provider is not liable for incorrect user decisions during navigation, breaches of regulations, fines or proceedings by authorities, damage to vessels or equipment, bodily injury, data loss, inaccurate or outdated coastline data, malfunction of GPS or location services, internet connectivity failures, or errors of third-party service providers.
The user must use the application reasonably and together with other reliable sources of information.
10. Prohibited use
The user must not use the application in a manner that endangers the user or others, encourages violations of maritime regulations, substitutes mandatory safety or navigation equipment, includes interference with the application, server, or data, or infringes third-party rights or applicable law.
11. Changes to the application and terms
The provider may modify, supplement, or discontinue the application, its features, data packages, settings, advertisements, or these Terms at any time.
Users may be notified of material changes in the application, on the website, or via the app store.
Continued use of the application after changes become effective constitutes acceptance of the revised Terms.
12. Intellectual property rights
The ShoreMeter application, its design, name, logo, user interface, source code, and other content are protected by copyright and other intellectual property rights, unless explicitly stated otherwise.
Data from open-source resources is used in accordance with the applicable license terms and attribution requirements of those sources.
13. Termination of use
The user may stop using the application at any time and remove it from the device. Removing the application may delete locally stored settings and downloaded coastline data, depending on the operating system.
14. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Slovenia, except where mandatory consumer protection rules or other mandatory provisions require otherwise.
Jurisdiction for disputes is determined by the competent court in accordance with applicable law.
